Liberty Linked Terms and Conditions

These Terms and Conditions ("Terms") govern the provision of recruitment services by Liberty Towers Limited ("we", "us", or "our") to you, the client ("you" or "your"), under the Liberty Linked service. By engaging our services, you agree to be bound by these Terms.

1. Definitions

1.1 "Liberty Linked" refers to the recruitment service provided by Liberty Towers Limited, utilising a premium LinkedIn advertisement and our resourcing capabilities to attract candidates directly to you.

1.2 "Candidate" means any individual introduced by us to you under these Terms.

1.3 "Fee" means the sum of £499.00 payable by you for the Liberty Linked service.

2. Services

2.1 We will place a premium LinkedIn advertisement on your behalf and utilize our resourcing capabilities to attract candidates for your specified role.

2.2 All candidates sourced through the Liberty Linked service will be directed to you for consideration and potential engagement.

3. Payment Terms

3.1 The Fee of £499.00 is payable in full prior to the placement of the LinkedIn advertisement.

3.2 Payment shall be made via BACs.

3.3 We reserve the right to withhold commencement of services until full payment is received.

4. Refunds and Additional Services

4.1 In the event that the advertisement does not yield successful candidates, no refund of the Fee will be provided.

4.2 As a gesture of goodwill, we offer you a reduced recruitment fee of 15% (normally 20%) of the candidate's first-year annual salary for any subsequent recruitment services for the same role.

4.3 An additional discount equivalent to the Fee already paid (£499.00) will be applied to the reduced recruitment fee mentioned in clause 4.2.

5. Your Responsibilities

5.1 You are responsible for providing accurate and complete job descriptions and requirements for the role.

5.2 You agree to inform us of any offers of employment made to candidates introduced by us. No additional fee is payable.  The advert will be closed.

5.3 It is your responsibility to verify the suitability, qualifications, and references of all candidates.

6. Liability

6.1 We shall not be liable for any loss, damage, or expense arising from any act or omission of a candidate introduced by us.

6.2 We do not guarantee the suitability of any candidate and accept no liability related to their performance.

7. Confidentiality

7.1 Both parties agree to keep confidential all information relating to the other's business that is not in the public domain.

7.2 This clause shall survive termination of these Terms.

8. Data Protection

8.1 We will process personal data in accordance with the Data Protection Act 2018 and the UK GDPR.

8.2 You agree to comply with all applicable data protection laws concerning the personal data of candidates.

9. Termination

9.1 Either party may terminate these Terms by giving written notice to the other party if the other party commits a material breach.

9.2 Upon termination, any Fees due shall become immediately payable.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

10.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Entire Agreement

11.1 These Terms constitute the entire agreement between the parties and supersede all prior agreements, understandings, and negotiations.

12. Severability

12.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Notices

13.1 Any notice required under these Terms shall be in writing and sent to the registered address of the other party.

14. Variation

14.1 No variation of these Terms shall be effective unless agreed in writing by both parties.
